Nisha King’s employment as a sergeant with Provo’s Police Department was terminated after someone filed sexual harassment claims against her. King appealed, and the Provo City Civil Service Commission upheld the Police Department’s decision. King now argues that the Commission improperly investigated the allegations against her under Provo’s, rather than the Police Department’s, policies. King also argues that the charges against her were not supported by substantial evidence and that the Commission abused its discretion by upholding the termination. The Utah Court of Appeals declined to disturb the Commission’s decision, holding:
- King failed to meet her burden of proving that the Commission’s alleged error in upholding Provo’s use of its own policy, instead of the Police Department’s policy, in its investigation was harmful.
- The Commission’s findings on both allegations were supported by substantial evidence in the form of credible testimony and corroborating evidence.
