A defendant was convicted of three counts of sexual exploitation of a minor. He argued on appeal that a police search of his residence violated his constitutional rights because it was based on the fruits of an unconstitutional pre-warrant search of his private computer files and because a material fact was recklessly omitted from the affidavit. The Utah Court of Appeals affirmed, holding in part:
- The trial court made no error when it determined that the defendant’s constitutional rights were not violated.
