The Utah Supreme Court held: 

  • Utah’s Uniform Public Expression Protection Act (UPEPA) applied to teacher’s claims because it concerned statements about a public-school teacher physically harming students, which is a matter of public concern. 
  • Practice tip: UPEPA applies to speech that relates to “any matter of political, social, or other concern to the community,” or when it concerns “a subject of general interest and [is] of value and concern to the public.”
