  • The district court did not abuse its discretion when it refused to give a jury instruction proposed by the defendant, which indicated that actual danger was not an element of self-defense, because the self-defense instruction accurately covered the elements of self-defense.
  • Practice tip: The standard of review for jury instruction issues should be determined as it is for any other issue on appeal. This means that the appellate court will ask if the issue presents a factual, legal, or mixed question of law and fact.
