- The district court exceeded its discretion when it excluded expert witness where expert designation was deficient, but deficiencies were not harmful
- Practice tip: Any rule that requires a “summary” of “opinions to which [a] witness is expected to testify” requires more than just a list of topics; such a rule necessarily requires at least a brief summary of the witness’s actual opinions regarding those topics.
