State v. Herman

State v. Herman, 2026 UT App 46 (per curiam)

Criminal Law

The Utah Court of Appeals held:

It lacked jurisdiction because the pretrial status order setting bail did not qualify as a final, appealable judgment and did not qualify for an immediate, expedited appeal under Utah Code § 77-20-209.

Practice tip:

If the district court sets a bail amount, the order is considered a conditional release order (as opposed to a detention order) and is not subject to an immediate, expedited appeal.
