The district court’s erred in awarding the full amount of fees to the defamation defendant. Remand was necessary for the court to decide the questions of relatedness and reasonableness.
Practice tip:
A successful defamation defendant requesting fees related to a special motion must show that a task was reasonably necessary to prosecute the special motion.
