The Utah Court of Appeals held:

(1) Individual business owners lack standing to seek emotional distress damages based on the degradation of the corporation because they are derivative of the corporation’s harm.

(2) Towing companies do not have a constitutionally protected property interest in remaining on a city’s tow rotation.

Practice tip:

When challenging a district court’s factual findings on appeal, practitioners must cite actual evidence in the record. Pointing to arguments of trial counsel is not enough because arguments of counsel are not evidence.
