Hospital Housekeeping v. Labor Commission, 2023 UT App 90 (Tenney, J.)

The Labor Commission ordered Hospital Housekeeping to continue to pay for Employee’s ongoing medical treatments due to an industrial accident that injured Employee over 5 years before. The Court of Appeals affirmed, holding:

  • The Labor Commission had substantial evidence to support its conclusion that the workplace accident caused Employee’s ongoing pain, despite a more recent medical opinion to the contrary.
  • Practice tip: An administrative law judge’s unchallenged order finding causation could become “the law of the case” in subsequent litigation. See paragraphs 21–22.
