The Labor Commission ordered Hospital Housekeeping to continue to pay for Employee’s ongoing medical treatments due to an industrial accident that injured Employee over 5 years before. The Court of Appeals affirmed, holding:
- The Labor Commission had substantial evidence to support its conclusion that the workplace accident caused Employee’s ongoing pain, despite a more recent medical opinion to the contrary.
- Practice tip: An administrative law judge’s unchallenged order finding causation could become “the law of the case” in subsequent litigation. See paragraphs 21–22.
