Jurisdiction

Mother sent her children, who had recently been adjudicated as abused by their father, to live with their grandparents after Mother’s boyfriend allegedly robbed a business while in the company of Mother and Children. Grandparents then intervened in the ongoing juvenile court case and petitioned for guardianship and custody, which the court granted. Mother appealed, asserting that the juvenile court lacked jurisdiction to grant the request. The Utah Court of Appeals affirmed, holding:

  • The juvenile court had jurisdiction from the time it considered the protective supervision services petition in Father’s case.
