A property owner sued several parties after they initiated foreclosure on a property he purchased in Mona, Utah. The district court grated summary judgment on the property owner’s quiet title and unjust enrichment claims and then granted summary judgment to a bank for its claim of judicial foreclosure on the property. The Utah Court of Appeals affirmed the ruling, holding:
- The district court correctly concluded that the property owner’s quiet title and unjust enrichment claims were barred by claim preclusion and that the statute of limitations on the bank’s judicial foreclosure claim had not run.
