- The district court properly took judicial notice of Petitioner’s statements and was free to consider them in its credibility determination.
- The district court’s findings regarding whether Respondent knowingly violated the injunction were not against the clear weight of the evidence.
- Practice tip: The court noted “wrinkles” in the civil-stalking statute: (1) it seems to allow an individual to avoid both civil and criminal responsibility for violating a temporary injunction by simply not reading the injunction, and (2) it seems to allow an individual to obtain a stalking injunction without meritorious allegations because the injunction can be issued before an evidentiary hearing is held.
