The Utah Supreme Court held:

  • The district court correctly concluded that a woman’s statements to an officer and a nurse were nontestimonial and do not implicate the Confrontation Clause.
  • The district court did not abuse its discretion in concluding that these statements fall within the hearsay exceptions for excited utterances and statements made for purposes of medical diagnosis or treatment.
