- Defendant failed to show that the district court committed obvious error regarding the unanimity instruction.
- Defendant failed to preserve his claim that trial testimony was inherently improbable. Sufficient evidence existed to support Defendant’s conviction.
- Practice Tip: When parties have agreed upon jury instructions below, on appeal, any errors in the jury instructions are better ascribed to the attorneys and not to the court.
