The Utah Supreme Court held:
- A general waiver of all rights associated with a debt secured by real property is broad enough to waive rule 69B(d)’s requirement that property be sold in “such parcels as are likely to bring the highest price.”
- Broad waiver language in loan documents was sufficient to dismiss Talisker’s claims for equitable relief, including those based on allegations of “gross inadequacy of price” alongside “irregularities.”
- The court declined to address any of the arguments Talisker raised for the first time in his petition for rehearing
