C.R. England Inc v. Labor Commission

C.R. England Inc. v. Labor Commission, 2024 UT App 170 (Harris, J.)

Employment

An employee was injured after a car accident. The Labor Commission ruled that the employee was owed total disability benefits and other expenses. The company appealed the decision, arguing that there was insufficient evidence supporting the award. The Utah Court of Appeals affirmed, holding:

  • The record contained substantial evidence in support of the Labor Commission’s decision.
  • Because the company’s petition for review was frivolous, the court could grant the employee attorney fees in the first instance.
