The Utah Court of Appeals held: 

  • There are no due process implications when lost potentially exculpatory evidence was not in the State’s possession. 
  • Because there was no evidence that the juror considered extraneous information or had an unauthorized contact, the trial court did not abuse its discretion in dismissing the motion for new trial.
