- After a 23B remand hearing, Defendant did not establish that he received ineffective assistance of counsel by (1) failing to present evidence or cross-examine the girlfriend, (2) failing to object to prosecutorial misconduct, and (3) allowing an entire pretext call to be introduced as evidence.
