Commercial Club Bldg. v. Global Rescue, LLC.
State v. Deuel, 2026 UT App 6 (Orme, J.)
Civil
The Utah Court of Appeals held:
- The district court did not abuse its discretion in ruling that the Fairness Requirement was satisfied and in finding in favor of Commercial Club on its alter ego theory.
- The district court correctly concluded that it was precluded from addressing the issue of prejudgment interest on remand.
- Practice tip: When an appeals court vacates a judgment with narrowing instructions which direct the district court to consider certain issues, the district court does not have a mandate to reconsider other issues except in extraordinary circumstances.
