Duffin v. Duffin

Duffin v. Duffin, 2025 UT App 136 (Christiansen Forster, J.)

Family Law

The Utah Court of Appeals held:

  • The district court did not err in determining that, in this case, Mother’s decision to send children to daycare was a physical custody decision rather than a legal custody decision, and therefore, Mother was not required to discuss the decision with Father.
  • The district court did not exceed its discretion in denying Father’s request to declare in advance his intent to care for the children rather than sending them to daycare.
