The Golden Spike Heritage Foundation sued the Box Elder County recorder for failing to perform his statutory duty to maintain accurate plat maps and records and refusing to correct errors related to the foundation’s interests. The district court dismissed the petition. The Utah Court of Appeals reversed in part, affirmed in part, holding:

  • The district court incorrectly dismissed the foundation’s petition for extraordinary relief to the extent that the foundation sought an order directing the recorder to accurately depict plat maps.
