Child made allegations of abuse against Father and stated he did not want to live with Father. Based on these allegations and Child’s threats of self-harm, the juvenile court adjudicated Child dependent as to Father. The Court of Appeals reversed, holding: 

  • Child’s ongoing need for psychiatric care and threats of self-harm did not make him dependent, and Father did not waive his right to contest the juvenile court’s dependency adjudication.
  • Practice Tips:
    • “Proper care” is a fact-specific inquiry. 
    • Even before a child is adjudicated, a juvenile court has limited and temporary jurisdiction over a child once a petition alleging abuse, neglect, or dependency has been filed.
