Johnson v. Department of Commerce

Johnson v. Department of Commerce, 2023 UT App 152 (Per Curiam)

Admin Law

Appellant petitioned the court to review the Department of Commerce’s order dismissing her request for agency review as untimely. The Utah Court of Appeals affirmed the ruling, holding:

  • The Department’s administrative rule requires parties to file via both email and mail or by mail alone. Because Appellant’s email alone did not meet the Department’s filing requirements, the Department lacked jurisdiction over the claim.
