The Utah Court of Appeals held:

  • The district court did not err by denying motion to dismiss based on failure to pierce corporate veil where claims were raised against individual.
  • The district court did not abuse its discretion by denying motion for jury trial where motion was filed on the eve of trial and where granting the motion would not resolve the primary concerns.  
  • The district court did not err by declining to recuse itself based on adverse rulings. 
  • There was sufficient evidence to conclude there was a breach of contract and damages.
