Merrill v. Merrill
Merrill v. Merrill, 2024 UT App 94 (Luthy, J.)
Family Law
Husband appealed the district court’s final order resolving issues relating to his divorce from Wife. Husband challenged the court’s calculation of the parties’ incomes, its determination of Wife’s reasonable expenses, its alimony award, and its valuation and division of the marital estate. The Utah Court of Appeals affirmed in part, reversed in part, holding:
- The district court’s ruling was largely within its discretion, with two exceptions: (1) the uncertainty regarding the tax rates to be applied to Wife’s gross income, (2) the possible inclusion of capital improvements to the Party City property in determining Wife’s expenses.
