Nucor v. Labor Commission
Nucor v. Labor Commission, 2023 UT App 164 (Christiansen Forster, J.)
Workers’ Compensation
Employee sought workers’ compensation and objected to the first medical panel’s report. A second medical panel then concluded Employee proved medical causation. The Utah Court of Appeals affirmed, holding:
- There was a sufficient basis for the Labor Commission to reject the first panel’s report because that panel lacked the specialists necessary to assess Employee’s conditions and did not interview or examine Employee.
