Workers’ Compensation

Employee sought workers’ compensation and objected to the first medical panel’s report. A second medical panel then concluded Employee proved medical causation. The Utah Court of Appeals affirmed, holding:

  • There was a sufficient basis for the Labor Commission to reject the first panel’s report because that panel lacked the specialists necessary to assess Employee’s conditions and did not interview or examine Employee.
