State v. Hernandez
State v. Hernandez, 2025 UT App 90 (Mortensen, J.)
Criminal
The Utah Court of Appeals held:
- Defendant’s inherently improbable claim was not preserved.
- There was sufficient evidence presented for the aggravated assault and obstruction charges.
- Practice tip: Inherently improbable issues must be specifically raised as such before the trial court or they will be considered unpreserved. General sufficiency of the evidence challenges in directed verdict motions are not enough to preserve an inherently improbable claim.
