After Defendant killed Father and attempted to kill Friend, he was charged with and convicted of a host of crimes, including murder and attempted aggravated murder. In a bifurcated trial for Father’s murder, the trial court determined that the jury could hear certain evidence regarding incidents with Friend, could not see certain phone records, and could see photos of Father’s deceased body. Defendant appeals these evidentiary rulings. The Utah Court of Appeals affirmed, holding:
- The district court did not abuse its discretion in allowing evidence relating to the bifurcated charges, in refusing to admit certain phone records, or in allowing the admission of a crime scene photo.
