State v. Raheem, 2024 UT App 29 (Orme, J.)


A defendant challenged his conviction for aggravated sexual assault claiming, among other things, that the State had failed to show evidence of the alleged victim’s non-consent. The Utah Court of Appeals affirmed, holding among other things:

  • The district court did not err when it denied defendant’s motion to arrest judgment. The State provided sufficient evidence to prove that the defendant had acted at least recklessly as to the alleged victim’s nonconsent.
