After trial, Defendant was convicted of murder, desecration of a body, and multiple counts of obstruction of justice. Defendant appealed claiming multiple theories of ineffective assistance of counsel, hearsay, and cumulative error. The Court of Appeals affirmed, holding:

  • On the evidence presented at trial, Defendant cannot show evidence of prejudice, and Defendant has not shown that remand under rule 23B will produce evidence of ineffective assistance of counsel under the circumstances at trial.
