State v. Sparling, 2024 UT App 59 (Harris, J.)
Criminal
During a traffic stop officers found methamphetamine in a car Defendant was driving. The State charged Defendant with drug and traffic offenses. After a bench trial, Defendant was acquitted of some of the drug-related charges but convicted of possessing methamphetamine. Defendant appealed that conviction, arguing insufficient evidence. The Utah Court of Appeals affirmed, holding:
- The evidence presented at trial was sufficient to support an inference that Defendant had both the power and the intent to exercise dominion and control over the methamphetamine.
