State v. Weaver, 2023 UT App 154 (Oliver, J.)
Criminal
Weaver crashed into a car stopped at a stoplight and killed the driver. The jury convicted him of negligent automobile homicide. The Utah Court of Appeals affirmed, holding in part:
- The court did not abuse its discretion in admitting Weaver’s text messages between him and his wife because they directly showed Weaver’s criminal negligence.
- There was sufficient evidence of Weaver’s impairment because the evidence showed Weaver had drugs in his system, knew driving with drugs impaired his driving, and that he was driving erratically.
