England Logistics v. Kelle’s Transport

England Logistics v. Kelle’s Transport, 2024 UT App 137 (Luthy, J.)

Employment Law

A competitor company hired several employees away from a transport company. The employees had all signed noncompete agreements. The transport company sued the competitor and employees. A jury found in the transport company’s favor on some claims, including that the competitor had intentionally interfered with economic relations and that the employees had breached their noncompete agreements. On appeal, the Utah Court of Appeals affirmed in part and reversed in part, holding:

  • The district court correctly concluded that the noncompete agreements were enforceable under Utah law.
  • The district court incorrectly denied the competitor’s motion for judgment as a matter of law on the intentional interference with economic relations claim.
