- The district court did not abuse its discretion under rule 403 of the Utah Rules of Evidence by allowing the State to present testimony about a prior sexual assault.
- Practice tip: If a court admits evidence over a rule 403 objection, the party who opposed admission could still argue to the jury that the incidents in question were not sufficiently similar so as to have any meaningful probative value.
