Abdelgader v. UDOT

Abdelgader v. UDOT, 2026 UT App 50 (Christiansen Forster, J.)

CIVIL PROCEDURE/STATUTORY INTERPRETATION

The Utah Court of Appeals held:

The district court correctly granted summary judgment to UDOT because it was entitled to immunity under Utah’s Governmental Immunity Act.

Practice tip:

As long as a highway’s design meets basic safety standards, UDOT’s decisions regarding inclusion of additional safety features are discretionary decisions entitled to immunity.
