Abbas v. State, 2022 UT App 137 (Mortensen, J.)

Abbas was charged with four counts of enticing a minor after he engaged in illicit sexual discussions and activity with a minor when he was 54 years old. He pleaded guilty, following the bad advice of his attorney that a guilty plea would help him avoid deportation. On appeal, he argues that he received ineffective assistance of counsel. The Utah Court of Appeals affirmed his guilty pleas, holding:

  • Abbas has not shown that he would not have pleaded guilty absent his attorney’s bad advice, and so he has not shown prejudice.
