Defendant was convicted of two misdemeanor charges and timely appealed. On appeal, appellate counsel concluded there were no meritorious issues on appeal. Despite many attempts over multiple months, appellate counsel could not locate Defendant to receive his input on the brief before filing an Anders brief. The Utah Court of Appeals accepted the brief, holding:
- The requirement to receive feedback from the defendant before filing an Anders brief can be waived if counsel cannot locate the defendant after diligent efforts.
