Big Game Forever v. Peterson, 2024 UT App 78 (Orme, J.)

Appellate Procedure

A journalist made a records request for the expenditure reports of a Company doing contract work for the State. The Department of Natural Resources provided redacted records. The journalist appealed the redaction, and after much litigation, the district court granted the journalist’s motion for summary judgement. The Company appealed the grant. The Utah Court of Appeals affirmed, holding in part:

  • The Company’s appeal fails because the district court gave multiple independent grounds for its decision, but the Company only challenged one.
  • Appellate Practice tip: An appeal has no chance of succeeding unless a party attacks each independent ground enumerated by the district court.
