Graves v. Utah County, 2024 UT App 80 (Christiansen Forster, J.)

Amended Opinion: Governmental Immunity

Woman filed a complaint against a Utah County Commissioner, Graves, for sexual harassment. Graves later sued Utah County, two commissioners who released his name to the media and called on him to resign, and Woman under a number of causes of action. The district court, however, granted a motion to dismiss Graves’s complaint. Graves appealed, and the Utah Court of Appeals affirmed, holding in part:

  • Amended Content: Footnote 5 explains that the Governmental Immunity Act of Utah subsection 63G-7-202(3)(c)(i) does not provide a blanket waiver of immunity for fraud or willful misconduct. Rather, it reflects an exception to a statutory exclusive remedy.
