E.S. v. University of Utah Med. Ctr., 2024 UT App 57 (Tenney, J.)

Jurisdiction

Plaintiffs sued University alleging it was negligent in hiring Nurse. University filed a motion for summary disposition, arguing Plaintiffs failed to comply with the Utah Governmental Immunity Act by not properly delivering a notice of claim to the University. The Utah Court of Appeals agreed, holding: 

  • The court lacked jurisdiction because Plaintiff failed to “strictly comply” with the Act’s procedure.
