Freight Tec Management Group Inc. v. Chemex Inc., 2021 UT App 92 (Orme, J.)

Procedure

Freight Tec and Chemex sued each other. Freight Tec responded to Chemex’s discovery responses in September and moved for summary judgment in November. Chemex received an extension from Freight Tec, and on the day the opposition to summary judgment was due, Chemex moved for an extension of time to file the opposition. The court denied that motion, and Chemex filed another motion for extension, which the court denied. The court ultimately granted summary judgment in favor of Freight Tec. The Utah Court of Appeals affirmed, holding:

  • Because Chemex did not offer an explanation about its three-month delay in analyzing discovery responses (the reason it gave for needing additional time to complete its opposition to the summary judgment motion), the district court did not abuse its discretion in denying Chemex’s motions for an extension of time to oppose the summary judgment motion.
