The Utah Court of Appeals held:
(1) Legal title to public streets dedicated in a municipal townsite plat vests at the time the public official enters or approves the plat. This interest takes legal priority over a subsequent federal land patent issued for the same parcel.
(2) Utah law recognizes a rebuttable presumption that public officials perform their official duties properly. If a historical record is incomplete, the burden rests entirely on the challenging party to provide sufficient evidence to overcome this presumption.
(3) Private claimants are prohibited from acquiring real property held by a government entity via adverse possession if that property is designated for a present or future public use.
