Lamb v. Lamb
Lamb v. Lamb, 2024 UT App 16 (Mortensen, J.)
Family Law
Husband’s and Wife’s divorce was decided at a bench trial. Husband was awarded custody of the children, ownership of a family business, and half the equity in the marital home. Wife appealed. The Utah Court of Appeals affirmed, holding:
- The district court did not abuse its discretion in its custody determination, in awarding the business to Husband, or in its division of equity in the marital home.
- Practice tip: The court emphasized the importance for adequate record cites and explanations of case law, “warning that future briefing of this nature will likely be deemed inadequate and that any arguments on the merits may not be substantively considered” by the court.
- Practice tip: Appellants who fail to address the district court’s reasoning also fail to carry their burden of persuasion on appeal.
