Fine v. University of Utah, 2024 UT 4 (Hagen, J.)

Contracts

Dr. Fine agreed to a suspension of his clinical privileges after the University received complaints about his medical work. The University then recommended Dr. Fine receive additional training, and Dr. Fine sued. The district court granted summary judgment to the University based on its bylaws, and the Utah Supreme Court affirmed, holding:

  • The plain language of the bylaws released the University from claims arising out of the doctor’s clinical privileges.
  • Practice tip: A hospital’s substantial compliance with its bylaws goes to the merits of a party’s claim, not a release agreement’s applicability to a lawsuit.
