State v. Goodall, 2024 UT App 100 (Oliver, J.)

Appellate Procedure

Defendant requested a remand to develop the record for a claim of prosecutorial and police misconduct, among other things. The district court denied his request to remand. The Court of Appeals affirmed, holding in part:

  • The district court correctly denied Defendant’s remand request.
  • Practice tip: Under rules 23B and 11 of the Utah Rules of Appellate Procedure, remand is only available to bolster a claim of ineffective assistance of counsel, not prosecutorial and police misconduct.
