A defendant challenged his several convictions, including possession of a controlled substance and failure to respond to an officer’s signal to stop. He claimed the evidence was insufficient to support his convictions and that he had received ineffective assistance of counsel when his trial counsel failed to request an unanimity jury instruction for failure to respond to an officer’s command to stop. The Utah Court of Appeals affirmed, holding:

  • The State presented evidence to support both charges.
  • The defendant could not demonstrate that he was prejudiced by the lack of an unanimity instruction.
