State v. Washington, 2021 UT App 114 (Mortensen, J.)

The defendant solicited a woman to have sex, and when she said no, he grabbed her shoulders and turned, trying to throw her onto the bed. The woman escaped, however, before anything happened. The court convicted the defendant of attempted rape. The Utah Court of Appeals affirmed, holding:

  • The defendant took a substantial step towards rape when he grabbed the woman’s shoulders and tried to throw her on the bed. Thus, the defendant’s conviction for attempted rape was not against the clear weight of the evidence.
