Waxies Enterprises Inc. v. Labor Commission

Waxies Enterprises Inc. v. Labor Commission, 2025 UT App 7 (Tenney, J.)

Administrative/Employment

The Utah Court of Appeals held:

  • The Court would not disturb the Commission’s decision not to compel a party to sign certain settlement documents because the Commission does not have authority to enforce settlement agreements.
  • The Court set aside the Commission’s decision that it had no power to potentially rescind prior approval of the settlement because the Commission had continuing jurisdiction over the issue.
  • Practice tip: The Court noted a “lingering issue” about “the limitations (if any) on the Labor Commission’s ability to exercise continuing jurisdiction” in some circumstances.
