State v. Roybal

State v. Roybal, 2025 UT App 27 (Luthy, J.)

Criminal

The Utah Court of Appeals held:

  • The district court did not abuse its discretion when it ruled that inquiry into past acts of violence would open the door to admit video of the act.
  • The district court did not abuse its discretion when it allowed evidence of Defendant’s prior felony conviction.
  • The district court did not err when it declined to instruct the jury that it could decide for itself both law and facts.
  • Defendant’s rule 23B motion did not merit remand.
