The Utah Court of Appeals held:
- Although the district court correctly held that the defendant’s behavior constituted civil stalking, its order that the defendant could not “annoy” or “cause distress” to the petitioner violated the First Amendment. The order was content-based and could not pass strict scrutiny.
- The district court did not abuse its discretion in denying the request for attorney fees.
